Our primary business is representing railroads. Railroads and their employees are governed by a unique set of federal laws and regulations. We handle claims involving employee injury claims typically brought under the Federal Employer’s Liability Act (FELA); the Locomotive Inspection Act (LIA); and the Federal Safety Appliance Act (FSAA). We also handle employee claims alleging violations of the whistle-blower, discrimination, and injury reporting provisions of the Federal Railroad Safety Act (FRSA) and the Occupational Safety and Health Act (OSHA).
Railroad Crossing and Track Incidents
We investigate incidents occurring at railroad grade crossings and on railroad property. We defend railroads, and often the train crews, who have had the unfortunate experience of encountering an unsafe driver or trespasser on the tracks that resulted in the injury or death of the individuals involved. We have also successfully brought actions for recovery of railroad property damages against individuals and companies who caused collisions and derailments on railroad property.

We defend employers accused of engaging in harassment, discrimination and retaliation under federal and state laws. We also represent employers accused of creating a hostile work environment or improperly retaliating against an employee. Real Property Disputes
We represent railroads and other property owners involved in eminent domain, nuisance, encroachment and quiet title actions. We have negotiated easements and real estate transactions.
